How to apply for EB2-NIW from overseas (outside the United States)

The Employment-Based Second Preference National Interest Waiver (EB2 – NIW) category of Green cards allows professionals with advanced degree and exceptional abilities self – petition for a green card. They can do so without a sponsor or the help of a lawyer and do not need a job offer!.

If you have purchased a copy of my EB2-NIW Tool-Kit or watched my YouTube videos online, you already know that I share a lot of information about applying for a green card from within the United States. However, you do not need to be living in the United States to apply for your green card under the EB2-NIW category. By the way if you are wondering what fields qualify for a green card under this category, here’s a good article for you.

EB2-NIW Tool-Kit

Here are the steps for filing an EB2-NIW green card application from outside the USA.

  1. Submit Form I-140 and supporting documents to USCIS with appropriate fees (check this link to see acceptable methods of payment. currently, $700).
Submit your Petition with the appropriate accompanying evidence

Checks and money orders accepted. The check or money order must be drawn on a bank or other financial institution located in the United States and must be payable in U.S. currency (make the check or money order payable to U.S. Department of Homeland Security).

 

If you live outside the United States, contact the nearest U.S. Embassy or U.S. Consulate for instructions on the method of payment. (Please see the USCIS website at http://www.uscis.gov/I-140 or call the National Customer Service Center at 1-800-375-5283 for the most current information about where to file this petition. For TTY (deaf or hard of hearing) call: 1-800-767-1833).

2. Once I-140 is approved, and you are not in the US, the USCIS will send the approved Form I-140 petition to the National Visa Center of the Department of State. The National Visa Center will send you a notice of receipt.  The National Visa Center will also send you another notice indicating the next steps, and when you should submit the immigrant visa processing fees and supporting documents.

3. Complete the consular processing at the closest US consulate office.

 Once your I-140 application is approved, here is the 12-step immigrant visa process ( you already have completed step 1, which is to “submit a petition”) . You will also find information on the fees on that page.

4. Interview process

An interview process is required for the EB2-NIW process. Be prepared to present the original copies of ALL the documents you submitted as supporting evidence  for your EB2NIW application.

5. If approved, Your immigrant visa will be attached to your passport to serve as evidence of your immigrant status until you receive the green card in the mail (in the US).

How to wear a face mask

Should you wear a face mask to protect yourself from the novel coronavirus? how do you safely wear a mask? 

While on a shopping trip to walmart the other day, just as I pulled into the parking lot, another car pulled up right next to me. Out came a nice looking lady wearing a pair of black gloves.  She was clutching her handbag as she hurridely walked into the store.

I wondered just how many places she had worn the gloves that day? had she worn it at work? to drive? my mind went racing! The problem about wearing a pair of gloves everywhere is that maybe you touch something contagious in one location, you then carry it with you and spread it to other locations as you move from place to place.  

One thing is sure,  if you are not going to put on protective gear like a face mask, you have to do so correctly, otherwise, do not put it on at all. Here are some guidelines to help you safely use face masks especially during the COVID-19 or coronavirus pandemic.

1. Wash your hands thoroughly before putting on and after taking off your face mask. 

2. DO NOT Wear face mask as a goatee.

3. DO NOT Wear face mask as a necklace.

4. DO NOT Wear face mask as a visor.

5. Avoid touching your mask while it is on your face. 

6. Throw used mask away.

7. Do not take off your mask to speak to people

This is the million-dollar question. 

Does my field qualify for the Employment-Based Second Preference National Interest Waiver (EB2NIW) green card application category?

USCIS has clearly stated that EB2-NIW is for individuals who are exceptional in the fields of science, art, or business. This includes musicians, athletes, scientists, businessmen, consultants, physicians, pilots, professors, artists, nurses, economists, therapists, lawyers and many more. 

While it is relatively easy to show that one is exceptional, the national interest waiver requirement is a bit difficult for some individuals to prove.

To satisfy the EB2-NIW requirement, the petitioner must show;

  1. Evidence of advanced degree
  2. Evidence of exceptional ability
  3. Satisfy the requirement for National Interest Waiver (NIW)

Thankfully I self-petitioned for my green card under the Employment-Based Second Preference National Interest Waiver (EB2 – NIW) category without sponsors or the help of a lawyer. So I know a lot about this process.

Evidence for exceptional ability (only 3 of the following is required)

  1. Official academic record showing that you have a degree, diploma, certificate, or similar award from a college, university, school, or other institution of learning relating to your area of exceptional ability
  2. Letters documenting at least 10 years of full-time experience in your occupation
  3. A license to practice your profession or certification for your profession or occupation
  4. Evidence that you have commanded a salary or other remuneration for services that demonstrates your exceptional ability
  5. Membership in a professional association(s)
  6. Recognition for your achievements and significant contributions to your industry or field by your peers, government entities, professional or business organizations
  7. Other comparable evidence of eligibility is also acceptable.

To satisfy the NIW requirement, you must show that;

  1. The proposed endeavor has both substantial merit and national importance
  2. You are well-positioned to advance the proposed endeavor and
  3. On balance, it will be beneficial for the United States to waive the job offer and labor requirements.

Are you Ready?

Are you Ready?

At the start of the year, I prayed for more opportunities but I failed to realize how they would come.

Last night I came home from work, super exhausted and hungry. My mentor called me up and asked me if I wanted to deliver a talk at a conference in CANADA, and if I said yes, I’d have to leave on the earliest flight in the morning.

Everything in me wanted to scream No!! I need time to prepare, a talk? I haven’t put my PowerPoint together, and wait CANADA?????

But she said “Ozi, you’ve got everything it takes.”

Who me? Ummmm ok

I told her to give me a second, and I’ll call her back. I turned to Adé (my husband) and caught him up on the offer.

GO! he said, That’s what you prayed for. 

Ummm when did I pray for ….. ohhhh….Yea.

 So I called her back and said YES! The very next day, I was on my way to Victoria, British Columbia!

Canada Here I come!

When I speak to younger audiences I tell them to stay ready.  Nothing happens by accident.

Everytime you pass up an opportunity to learn a new skill, speak at a gathering, fill out a scholarship  application, that’s one less opportunity.

 You may not see the opportunity right now, but it’s coming, and when it comes, I hope you have supporters in your life who see the potential even when you don’t, I hope you take it!

Go ahead and plant the seeds and wait for the rain, while you are waiting, Take your umbrella with you as you head on out everyday ( I mean stay optimistic). I got to meet really amazing people at the conference, learn new and cutting edge science, and see e beautiful island; Victoria British Columbia.

 

Opportunities will show up, but they may sometimes be disguised as random calls at the end of a long day, unpaid internships,a friend sending you a scholarship application, even an Instagram page with 3 followers asking to feature you on their page (wait to what audience?), yup! Remember every page starts with a single follower, stay humble.

You probably are learning calculus right now, and wondering when you would ever need that knowledge. Maybe the lesson is character building for managing something big in the future. Maybe the purpose of it all is for you to meet a study partner, who will be instrumental to your success.

I started the Tales of an African Princess in America podcast (#TAPApodcast) in February 2018, to share my experiences, as an African woman in America. I believe in the transformative power of stories. I try to inspire young girls to seek further education in science, engineering, technology, and mathematics (STEM) by sharing my story. On the podcast, I also advocate for healthcare. I believe that we make the best choices when we are well informed. My Name is Dr. Ozi. I am the Host of the Tales of an African Princess in America Podcast

 In 2019, so many amazing things happened on #TAPAPpodcast. We released our 90th episode, started a youtube channel, and cohosted our very first live podcast in Texas USA!!!!.

It’s that time of the year again. Time to make new year resolutions. I found myself sucking in my belly in photos in 2019. In 2020, NONE OF THAT!!! Last year I was the heaviest I have ever been. One thing they don’t tell you about the early years of marriage is the weight gain. Some call it the “peace of mind” weight gain, or “happiness” weight gain.
